CANDIDATE TERMS AND CONDITIONS
1.1. These Terms and Conditions (“Terms”) define the basis on which you, as an individual wishing to apply for a role (“Individual”), may use our services and our website (www.hiringcircle.co.uk). References to “you” “your” or other similar terms are construed accordingly.
1.2. The terms “we”, “us”, or other similar terms used in these Terms mean Hiring Circle – a trading style of Richards Wallis Ltd – a company incorporated in England, company number 09309066 – with registered address 20 Alyth Road, Bournemouth, BH3 7DG (“Hiring Circle”).
1.3. Any reference to Hiring Circle, we, us or similar terms shall include any parent, subsidiaries, affiliates, officers, directors, agents and employees of Hiring Circle.
- Our Services
We are solely a digital platform (“Platform”) designed to remotely connect Individuals with roles at potential employers (“Employers”). We are not an employment agency or business for the purposes of the Conduct of Employment Agencies and Employment Business Regulations 2003.
2.1. We do not verify the information contained in the job advertisement nor do we assess the quality, safety or validity of the information contained.
2.2. The site and service are provided to you on an “as is” basis for your information only.
2.3. You agree that we make no express of implied recommendation as to the suitability of any role and accept no liability for the information contained in the Platform or any decisions made as a result of it.
2.4. You agree that we are not party to any contract actually entered into by any Employer or Individual and that you have not relied on any information supplied by Hiring Circle in entering into any agreement.
- Applying for a Role
One you have obtained a login you can review opportunities via the platform and apply directly to the relevant Employers – submitting your CV and other information you deem relevant. You are solely responsible for the application and we do not edit the information you present to Employers (unless we notify otherwise you in advance).
- Accepting a role
You agree to notify us as soon as possible after accepting any role with an Employer you have been introduced to through the Platform. You also agree to provide details of compensation levels.
- Your Warranties
You confirm that:
- You are at least 18 years;
- All information you submit will be accurate, truthful and not misleading;
- You will not seek to impersonate another person;
- You will keep the information provided updated on a regular basis;
- You will not post material that is incomplete, fraudulent, defamatory, libellous, malicious, likely to be offensive or in breach of any laws in the country of posting or the UK;
- You will not post material non-public information;
- You are authorised to share all information you provide; and
- You will take reasonable measures to ensure that any information posted does not include any malware, worms, viruses, spyware, trojan horses or other similar electronic code that may cause damage or loss.
- Registration User Names and Passwords
6.1. You are responsible for maintaining the confidentiality of your registration user name and password.
6.2. You agree not to disclose or share your login details with any other person or organisation.
6.3. We may deny access to the Platform if we reasonably believe that it is being (or may be) used by an unauthorised person or that the registered user is breaching these Terms.
- Our Rights
7.1. We reserve the right to fully control who is granted access to the Platform and to remove access at our discretion. An explanation for the reason is available by contacting us at email@example.com.
7.2. We reserve the right to remove content where we believe:
- It is contrary to local, national or international laws including but not limited to laws relating to employment, equal employment opportunity and employment eligibility requirements, data protection/privacy, data access and use, and intellectual property;
- It is found to be a misrepresentation relating to the Individual’s credentials;
- It is contrary to our best interests; or
- It should be removed for any other reason.
- Use of your Information
8.1. Employers will be provided with the information you submit as part of the application process as well as the personal information you have provided to Hiring Circle (including, but not limited to, compensation details, contact details and nationality).
8.2. Any information an individual provides will only be used by Hiring Circle to determine their eligibility to join the Platform and to determine potentially relevant employment opportunities.
8.3. No information will be passed to any organisation or third party except as part of an application process for a specific role – as controlled by the Individual.
- Privacy and Data Protection
- Your use of Information
10.1. Individuals will not engage in any business directly or indirectly with Employers introduced to them either via the Platform or otherwise by us, except as contemplated under these Terms. You accept that if you do so we may suffer monetary damages.
10.2. You agree not to share information about Employers or Roles contained in the site with anyone.
10.3. This platform is solely for the use of Individuals seeking employment opportunities advertised on the site. Any employment agencies, employment businesses or any of their affiliates, employees, directors or agents accepting these terms are agreeing to pay an Employment Agency Fee of £10,000 + VAT per month from the date of accepting.
- No Warranty
11.1. You agree that we have no control over the truth, accuracy, quality, safety or legality of the information potential employers provide in relation to available employment opportunities. We therefore make no warranty in respect of the Information contained on the Platform.
11.2. We do not control, authenticate or verify information posted by Employers on the Platform and you use the Platform at your sole risk.
11.3. You will perform your own due diligence to satisfy yourself with all information material to your decision to enter into any contract.
- Our Liability
12.1. You should obtain independent verification of any information provided on our Platform that you rely on to make decisions.
12.2. Nothing in these Terms shall limit or exclude our liability for fraudulent misrepresentation, or for death or personal injury resulting from our negligence or the negligence of our agents or employees.
12.3. Subject to the foregoing, we will not be liable for any economic losses (including, without limitation, loss of revenues, profits, contracts, business or anticipated savings), any loss of goodwill or reputation, or any special, indirect or consequential damages arising out of or in connection with your use of the Platform, the role information or these Terms.
12.4. We have no liability for the acts or omissions of other providers of telecommunications services or for faults in or failures of their networks and equipment.
12.5. In the event that we are found liable by a court of competent jurisdiction, our liability to you or any third party in any circumstance is limited to £2,000.
- No Partnership
13.1. You and Hiring Circle are independent from one another, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by these Terms.
14.1. You agree that these Terms and may be automatically assigned by us, at our sole discretion, to a third party in the event of a merger or acquisition or similar corporate transaction.
14.2. You may not assign, license or sub-contract any of your rights or obligations under these Terms.
- Links to other websites, intellectual property rights
15.1. Our website may include links to external websites operated third parties. We do not guarantee the content or privacy practices of any external websites and do not accept responsibility for those websites.
15.2. The contents and design of our website, any database rights and all other intellectual property rights in our website belong to us and may not be used or re-produced without our express consent.
15.3. HC is a registered trade mark.
- Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of England and you hereby accept the exclusive jurisdiction of the English courts.
- Variation of these Terms
We have the right to amend these Terms from time to time and the latest terms will be published on the website. Your continued use of the website will be deemed acceptance of the terms.
